Softricks Popup Date Picker License

Throughout this licensing agreement, "We/us" would mean Softricks.com. "You" would mean the licensee. "Software/product" would mean the "Softricks JavaScript Popup date picker calendar script".

    1. License Grant and Licensing Fees.

      TYPES OF LICENSES: Subject to the payment of applicable license fees as mentioned below and subject to the terms and conditions posted in this document, we grant you a non-exclusive, non-transferable right to use this software. The licensing fee should be finalized with us on a case-by-case basis. We offer the following standard licenses:

      1. Single Use Website License: When the software is used on a single website on a single server (no limit on the number of users).
      2. Single Use Application License: When the software is used in a single standalone application. License Fees are applicable per installation.
      3. Enterprise License: Unlimited perpetual license to use this software. This license will allow you to use this script in unlimited number of installations of your website(s)/product(s).
      4. Volume Licensing or other: You can buy more than one Website/Application licenses with this option. There are certain discounts applicable for more than one licenses.

      The component can only be embedded in the product(s) it has been licensed to. Additional licenses may be required for additional usage.

      ACCESS TO SOURCE CODE: You may request the source code when you buy the license and are allowed to modify the source code to suit your requirements. However, in no circumstances are you allowed to sell/redistribute/claim ownership to the script in any manner. The original copyrights should remain intact.

      LICENSING FEES: The current licensing for this script is free for personal, educational and non-profit purposes only. It is also free for applications distributed under the GNU Licenses.

      For all other and commercial use, we are charging the following licensing fee -

      1. For commercial websites we charge US $29.99 per website/server. (Single License)
      2. For commercial standalone applications, we charge US $49.99 per installation. (Single License)
      3. If you are interested in volume licensing, please do let us know more details about how many licenses you need or the number of servers involved etc. We offer discounts on volume licenses.
      4. We also offer one-time/enterprise licenses (which allow you to use this script on unlimited basis) priced at US $500/-.

      OBTAINING A LICENSE: The standard procedure for acquiring a license from us is to -
      1. Let us know your requirement.
      2. Raise a purchase order. (optional)
      3. Request an invoice from Softricks.com (optional).
      4. Send in the payment.
      5. Get the final license.

    2. Term.

      This Agreement is effective for an unlimited duration unless and until terminated earlier. Either party may terminate this agreement with thirty (30) days notice. This agreement will terminate automatically if you fail to comply with any of the conditions or requirements described here. Upon termination or expiry of the agreement, you must destroy all copies of the software and related documentation.

    3. Updates.

      You are entitled to download future bug fixes and releases of the software as and when Softricks.com publishes it on the website. At our discretion we may at any future point charge an upgrade fee for new releases, which contain significant enhancements, or for any custom changes/maintenance.

    4. Ownership.

      The product is completely owned by Softricks.com and its partners. We own the copyright and all rights for the software including the intellectual property rights. All copies of the software should keep this record at all times. Softricks.com reserves the right to sell the software to any other vendor/customer along with any custom changes that may be requested by you.

    5. Restrictions.

      You may not rent, lease, sell, loan or resell the software in any manner other than as allowed by the license. Modifying the software in any manner will not transfer ownership of the software to you in any circumstances.

    6. Warranty and Disclaimer.

      THE SOFTWARE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PROVIDED BY THE APPLICABLE LAW, WE DISCLAIM ALL WARRANTEES, EITHER EXPRESS OR IMPLIED, INCLUSIVE BUT NOT LIMITED TO ANY ACCIDENTAL DAMAGE BY USE, STORAGE OR HANDLING OF THE SOFTWARE. WE MAKE NO CLAIMS AND DO NOT PROVIDE WARRANTEE THAT THE SOFTWARE IS OR WILL BE ERROR-FREE OR FREE OF INTERRUPTIONS OR FAILURES OR THAT IT WILL MEET YOUR NEEDS.

    7. Limitation of Liability.

      UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO YOU OR TO ANY PERSON FOR ANY INDIRECT, DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES DUE IN PART OR FULLY TO THE USE OF THIS SOFTWARE. The software is not fault-tolerant and is not designed or tested for high risk implementations requiring fail-safe performance. We will not be responsible for any impact of the enclosing product in any manner. The cumulative liability for direct damages by either party shall in no event exceed one hundred percent (100%) of the license fees paid by you to us .

    8. Miscellaneous.

      Softricks.com or its partners may list your name/logo/reference as one of their clients in their business brochures.
